⚖ Gonçalo Amaral wins libel appeal

The detective at the centre of the McCann case, Gonçalo Amaral, has today won his appeal against his April 2015 libel conviction for the publication of his book, “The Truth of the Lie”, his account of events in the Algarve. At the time, Amaral was ordered to pay 500K Euro in damages.

The McCanns are now taking this to the Portuguese Supreme Court to attempt to get the appeal verdict overturned.

The Establishment takes another blow to the head. I am soo happy for him. A good man, doing his job, fucked over good and proper by the British Government.

Maybe now, the truth can finally come out, in it’s full grisly detail.

For those who don’t know, as the British Press were silenced by Carter Ruck and the courts…

Eddie and Keela, two British cadaver dogs, who in over two hundred cases, had NEVER given a false alert…

alerted to the fact that a corpse had been detected as having recently been in Apartment 5A at the Ocean Club (the lying McCann’s villa) in Prai da Luz, and that the same corpse had been transported in the hire car used by the McCann’s, 28 days after poor little Madeleine’s “disappearance”.

DNA matched to 15/19 markers as a positive ID for Madeleine, which was found in the boot of the McCann’s car.

All covered up by the Government, in particular by the personal intervention of Gordon Brown, and Tony and Cherie Bliar.

We got into the topic over on SaintsWeb, with some of the rather long, but rather dry RichPlanet documentaries out a while back. SOG was good enough to believe me when I claimed a four hour documentary was worth watching. We got into the topic thereafter, if shouted down by the usual suspects. I seem to remember them all declaring a fait accompli when the original verdict was returned. This still has the Supreme Court to go, so it could yet get overturned.

I wonder if it will.

From the outset, there has been a great deal of bewilderment in the general population, especially the breeders, about how this even happened. For some, the idea of leaving your kids on your own in a foreign country just won’t and will never compute.

I may be misreading what I’m seeing online, but the vast majority of commentary out there was critical, even before this verdict was returned. To be clear, that proves fuck all in terms of their involvement in anything, but it does suggest that public sympathy could have shifted.

Few of the same players are around in positions of power. If the Portuguese justice system is as pissed off as the anecdotal-and-handy-for-my-argument British public seem to be, it’s entirely conceivable that the McCanns may not get the result they want from the higher court.

Then what happens?

I really thought I’d be facing a forum that had never heard the truth about what happened to poor little Maddie, and that you’d all think I was a loon.

I have to be reeeaally careful here. Having been so involved in researching into the truth of what really happened that week in Praia da Luz, and having people I’ve come to consider friends face court cases for speaking that truth, I know full well what Carter-Ruck will do to those who dare to defy the cover-up, and speak out. I don’t want to bring those cunts onto you Pap.

Also, I’ve already consumed rather a few quantities of alchoholic beverages this eve in celebration, and not only am I struggling to make sure I hit the rights keys with my fingers – there is sooo much I could say right now about this case, that I need to drag myself away before I shloshedly spill too much that I shouldn’t.

But if you knew what I do about Gerry and Kate McCann (and maybe you do?), about his CATS File 19309 for Child Abuse in connection to Operation Orr, about the horrific nature of the “over 200,000 images” found on Gerry McCann’s computer, and about the nature of what that sordid little “family holiday” in Portugal was really all about, you might understand why I am so elated tonight at this fantastic news. This has been years in the coming.

I found out on my way home this eve. Celebrated it like Saints had just won the Premier League! A few curious looks came my way. Was straight on the phone to Ms. Schitt, and she didn’t even say hello, was just all “OMG!!! HAVE YOU HEARD!?! HAVE YOU HEARD!!!???

If you rule out the kind of corruption that can reach the very top all over the world – then I don’t think the McCann’s have much solid ground to stand on.

This is a translation of the the Conclusions of the Appellate Court today:

All three Judges unanimously agreed on that statement and verdict. And it is crystal clear.

I don’t see where the lying McCann’s can go from here. I doubt another appeal would go beyond the initial consideration at the lodgment stage in court.

What we can get away with saying legally (this has been tested previously) – is that all the evidence indicates that no “abduction” ever took place (there were absolutely no sighns or evidence of abduction, the McCanns blatantly lied about the damage to shutters etc.) and that all available evidence suggestes that Madeleine sadly died in apartment 5A, and that her body was hidden, then later removed for permanent burial elsewhere.

The 100% reliable cadaver dogs alerted to the scent of corpse, and found traces of blood that had been surgically cleaned (in the same spot behind the sofa where the strongest traces of cadaverine were found) in Apartment 5A (the McCann’s), in the McCann’s hire car, on Kate’s clothes, on Cuddle Cat (madeleine’s soft toy), and many other McCann related items. The dogs alerted to nothing else, anywhere else in Praia da Luz (they were tested) – only on things the McCann’s had been in contact with.

Like Gonçalo Amaral and all the Portuguese (and many British) police say – that is the evidence, and the evidence doesn’t lie. The McCann’s do.

Gonçalo focusses on the “theory” that it was an accidental death, purely (as he has said himself) because that was by far the most certain to gain a conviction in the Portuguese Courts. Although there is indeed also evidence to suggest more sinster reasons. But I won’t go there on Pap’s forum. not fair to him to attract that kind of attention.

So rather than overtly outright say “they did it”, we simply say that all the evidence points in the direction that Madeleine died in appartment 5A, and draw from that the conclusions that you will.

On the other hand, we cannot see how the right of the subjects of this appeal [Kate and Gerry McCann] to benefit, following their constitution as arguidos, from the guarantees of the penal process – including the right to a fair investigation and the right to freedom and safety – may be offended by the contents of a book which, in its essence, describes and interprets facts that are part of an inquiry whose contents have been published.

Nothing opposes that, although they have not been deemed sufficient to lead to a criminal charge, said facts are subject to diverse appreciation, namely in a work of literary nature.

Therefore, and because it is contained within consecrated rights, namely under numbers 37 and 38 of the Constitution, the publication at stake must be considered lawful.

I know sweet FA about the case, so I ask this question only becasue I am interested. If the McCanns had topped the poor little girl, or found her dead in the apartment, how would they have got away with leaving a body for 28 days behind the sofa in a rented apartment, with coppers crawling all over it and then to be free from enough suspicion to be able to blag a body (with 28 days decay) in the middle of the night into a motor to dispose of it? I assume the property was rented, but don’t know. I assume coppers were crawling all over it from the moment they were called, but don’t know and I assume the body would have been in a right old state 28 days later, but again, I don’t know.

I’m not trying to be a clever cunt, just a curious one!

Gonçalo Amaral is to countersue the McCanns.

The libel defeat is already being span by the McCann camp as something that has depleted the find Maddie fund (they’re no longer getting the payout). Being countersued won’t help.

Can’t imagine all those people who paid into the fund are too pleased about the monies being used to protect Kate and Gerry McCann, particularly if such protection goes against the aim of the fund.

Gonçalo Amaral is going to counterattack after the Lisbon Court of Appeals ruled in his favour in the case against the McCanns. The judges considered that the former PJ Inspector does not have to pay 500,000 euro in damages and has the right to sell the book ‘Maddie, The Truth of the Lie’, as well as the documentary which was broadcast by TVI, thus overturning the decision of the Civil Court of Lisbon.

As I said in my post, I am not knowledgable with the case at all and I was taking JS’s post at face value, e.g. body hidden for 28 days in a property which was subject to police examination, is on the face of it, an almost impossible thing to pull off. I am curious as to how it would have been carried out, if true.

JS is obviously well read on the case and invited questions, so I asked some. Thanks for your video, but unfortunately, i have a shitty internet connection at work, so will have to wait for later to view.

Phew! After the absolute mess I made of my attempted “match report” on the Newcastle game after a few too many shandies, I am relieved to read back and find that I actually managed to put together a pretty reasonable effort at covering the most important bases without including anything that could bring a good old Carter-Rucking up Pap’s metaphorical aris.

In other words – GA’s book, is a presentation of the facts established by the police investigation, all of which is on the record.

One cannot challenge proven facts in a court of law, with pure ‘speculation’ (lies) for which there is absolutely no evidence to back up the basis of your argument. The facts will always win out, unless proven otherwise by some new, otherwise previously unknown information.

The McCanns attempted to do this – silence facts, with pure supposition – and finally, after a very long process – lost.

Bear, as much as I’d love to have upvoted your post for it’s comic value, in this instance – we are talking about the tragic death of a poor little girl, whose suffering must’ve been unimaginable (when you know many of the details which cannot be publicly spoken of at this point without legal action ensuing).

Funny post mate – but Madeleine is sadly the biggest victim in this whole affair, and ultimately this is what this process is all about. Justice for Madeleine.

Just something important to add, that I legally can because it is a matter of PJ Files record, is one of the Statements of Dr. Gaspar, who previously holidayed with some of the infamous “Tapas 9” group, alluding to the nature of these holidays.

Statement of Dr. Katherina Gaspar : (regarding behaviour of David Payne and Gerry McCann)

One night, when we were on holiday, the adults, in other words, the couples that I mentioned were on a patio outside the house where we were staying. We had been eating and drinking.

I was sitting between Dave and Gerry whom I believe were both talking about Madeleine. I don’t remember the conversation in its entirety, but it seemed they were discussing a possible scenario. I remember Dave telling Gerry something like ?she?, referring to Madeleine, ?would do this?.

When he mentioned ?this?, Dave was sucking on one of his fingers, pushing it in and out of his mouth, whilst with the other hand he circled his nipple, with a circulating movement over his clothes. This was done in a provocative manner there being an explicit insinuation in relation to what he was saying and doing.

I remember that I was shocked at this, and looked at Gerry, and also at Dave, to see their reactions. I looked around (page 4) to see ?did anyone else hear this, or was it just me?. There was a nervous silence noted in the conversations of all the others and immediately afterwards everyone began talking again.

I never spoke to anyone about this, but I always felt that it was something very strange and that it wasn’t something that should be done or said.

Apart from this, I remember that Dave did the same thing once again. When I refer to this, I want to mention again that it was during a conversation, in which he was talking about an imaginary situation, though I could not say precisely what it was about. I believe that he was talking about his own daughter, L., though I’m not certain. He slid one of his fingers in and out of his mouth, while the other hand drew a circle around his nipple in a provocative and sexual manner. I believe that he was referring to the way that L., would behave or would do it.

I believe that he did this later on, during the holidays, but I cannot be sure.
